TERMS OF SERVICE

Please read these Terms of Service ("Terms") carefully before using the NoteSam application and services.
1. ACCEPTANCE OF TERMS
By accessing or using NoteSam, you agree to be bound by these Terms. If you disagree with any part, you may not access the Service.
2. ACCOUNTS
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account
- You must be at least 13 years old (16 in the EU)
- One person per account, no shared accounts
3. FREE AND PRO PLANS
Free Plan:
- Unlimited notebooks & pages
- 10 built-in templates
- Local storage only
- Community template browsing
Pro Plan:
- Unlimited notebooks
- All templates including premium
- Cloud sync (NoteSam or your own provider)
- AI features (summarize, flashcards)
- Priority support
4. SUBSCRIPTIONS AND PAYMENTS
- Pro subscriptions are billed monthly or annually through Apple App Store or Google Play Store
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
- Refunds are handled by Apple/Google per their policies
- We reserve the right to change pricing with 30 days notice
5. YOUR CONTENT
- You retain all ownership of notes, drawings, and content you create
- We do not claim any rights to your content
- You grant us a limited license to store and transmit your encrypted data solely for providing the sync service
- We cannot access your content due to end-to-end encryption
6. TEMPLATES
- Built-in templates are licensed for personal and educational use
- Community-uploaded templates must be original work
- We reserve the right to remove templates that violate these terms
- Template creators retain copyright of their work
7. ACCEPTABLE USE
You may not:
- Reverse engineer, decompile, or disassemble the app
- Use the service for illegal purposes
- Upload malicious content or malware
- Attempt to gain unauthorized access to our systems
- Resell or redistribute the app
8. AI FEATURES
- AI features use the Anthropic Claude API
- Text you submit for summarization/flashcards is processed by Anthropic
- We do not store AI-processed content on our servers
- AI outputs may contain errors and should not be relied upon as sole source
9. INTELLECTUAL PROPERTY
- NoteSam, the NoteSam logo, and associated marks are trademarks of Cryptosam LLC
- The app software is proprietary and protected by copyright
- Open source components are attributed in the app's About section
10. LIMITATION OF LIABILITY
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
11. TERMINATION
- You may delete your account at any time from Settings
- We may suspend accounts that violate these Terms
- Upon termination, your cloud data will be deleted within 30 days
- Local data remains on your device
12. GOVERNING LAW
These Terms are governed by the laws of the State of Florida, USA. Disputes shall be resolved in courts located in St. Petersburg, Florida.
